ArabViews Terms and Conditions

1. Use of the Site

The website https://arabviews.com, or any of its subdomains (the “Site”) or web applications (the Site and web applications are hereinafter referred to as the “Platform”) is the property of Macro Media Services FZ-LLC, and is operated by and licensed to Modern Middle East Media LLC in the Kingdom of Saudi Arabia, (and together with its affiliates hereinafter referred to as “Company”, “we”, “us”).

You acknowledge and agree that your access to and use of the Platform is subject to and governed by the following terms and conditions (the “Terms”).

By using the Platform including your participation to our survey panel, you agree that these Terms are legally binding on you, and shall take effect immediately on your first use of the Platform. If you do not agree to these Terms, please do not use the Platform.

We reserve the right, at our sole discretion, to revise or update all or part of these Terms from time to time. All changes are effective immediately when we post them. Please check these Terms periodically for changes. Your continued use of this Platform following the posting of revised Terms means that you accept and agree to those changes.

Your access to the Platform may be terminated immediately without notice from us, in our sole discretion, should you fail to comply with any term or provision of these Terms. Upon termination, you must cease use of the Platform and destroy all materials made available to you through the Platform and all copies thereof, whether made under these Terms or otherwise.

Any unlawful or unauthorized use of or access to the Platform can result in legal action against you.

1. Access to the Platform

You acknowledge and agree that your access to the Platform is for non-commercial use only. For example, this means that you are not permitted to resell or trade any Points (as defined below) rewarded to you. You may download one copy of the materials made available to you on any single computer for your personal, non-commercial use only, provided that:

1. you keep intact all copyright and other proprietary notices and marks contained in the materials;
2. you make no modifications to the materials;
3. you do not use the materials in a manner that suggests an association with the Company or any of our products, services, or brands;
4. you do not download quantities of materials to a database that can be used to avoid future downloads from this Platform. For purposes of these Terms, the use of any such materials on any other website or computer environment is prohibited.
5. You agree not to alter or create any derivative works from the Platform content, including from the materials.

1. Registration and creation of Account

To become a panelist, you are required to register with us by creating a membership account. When completing our registrations forms, you agree to provide true, accurate, consistent, and complete information about yourself and to update such information as necessary, failure of which, will allow the Company, at its sole discretion, to suspend or terminate your membership. If your account has been suspended or closed, you have the right to ask us to investigate the situation. In that case, please contact our support team. The following personal information and personally identifiable information will be required: your first name, your last name, your date of birth, your gender, your e-mail address, your mobile number. We may also ask you to provide us with additional relevant information such as for example: information about your income (in brackets), about your family status, about your education or professional levels or information about your identity or location (such as your passport information and your mailing address). Please refer to our privacy policy  to understand how we securely store, use, and share the data and information we ask you to share with us upon registration or during your membership period and the data or information we collect from your use of the Platform and your interaction with its content and materials.

You are eligible to create an account with us and become a panelist only if you are above the age of 16, of any nationality so long as you reside in any country within the Territory (at the time of updating these Terms, the Territory means the Kingdom of Saudi Arabia)[1]. Each person subscribing can only own one account on the Platform. You undertake to refrain from creating more than one account with us, and you acknowledge and agree that we have the right to terminate or suspend any additional account(s) you appear to hold and any Points earned in relation to such additional account(s) will be forfeited.

During the registration process you will receive from us a confirmation e-mail or SMS to confirm your account creation and/or activation.

Your account must be accessed only by you. You are responsible for keeping your log in information secure and confidential and you agree to notify us immediately of any unauthorized access you become aware of. Any Points gained by such unauthorized access will be reclaimed by us.

By registering with us and accepting these Terms, you agree to receive invitations to participate in our surveys on your registered email, accompanied with a notification on your registered mobile number. You acknowledge and agree that the Company will, at its sole discretion, select you to participate in a survey noting that we do not guarantee any minimum number of invitations or any invitation at all. Upon receipt of an invitation to participate in a specific survey, you have the option to either accept or reject such invitation as you deem fit, and you will not be penalized in case you decline the invitation.

Invitations to take a Survey are sent based on criteria we define and determine in our sole discretion, such as your interests or the group we wish to target. Our surveying system is designed in a way that allows you to participate only once to any survey you accept to answer. In any case, you acknowledge and agree to refrain from trying to answer any survey more than once. As soon as your answers are submitted, you will no longer be able to modify them.

Should you accept our invitation to participate in a survey, you commit to provide truthful and honest answers and to complete the survey to the best of your ability.

You acknowledge and agree that we have the right to terminate your account at our sole discretion if we believe that you have breached these Terms or provided us with untrue, inaccurate, false or misleading information and we shall not be liable to you for any termination.

1. Your Points

When you participate in our surveys, you may be rewarded with points (“Points”) which have a monetary value (as published from time to time on the Platform) that can be redeemed for gift card vouchers powered by our e-vouchers suppliers. You will be made aware of the number of Points earned before and after the completion of the survey. You will earn Points only if you comply with the instructions and procedures set out in these Terms and from time to time on our Platform. You may log into your account to check the completed surveys and the number of Points earned. You need to collect a minimum of 66.7 Points (equivalent to 25 Saudi Riyals “SAR”) in order to redeem your Points.

You are the sole beneficiary of the Points and, consequently, you are not allowed to transfer your Points to other accounts.

Our surveys’ Point-generating value is estimated and determined at our discretion taking into consideration various factors we solely define, such as the topic and the length of the survey. Upon receiving an invitation to take the survey, you will be informed of the number of Points that you may obtain if you answer the survey in full. You can find the full Points Policy below.

There is no expiration date for the Points you earned. As long as your account is active and the Points are not forfeited, you may redeem your Points for rewards we make available from time to time in the form of redeemable gift card vouchers. However, this does not mean that the gift card voucher obtained upon redeeming your Points does not have an expiration date. Therefore, we highly advise you to review the terms and conditions of our gift card vouchers program suppliers which we shall make available on our Platform.

We reserve the right to increase or decrease the number of Points you earn as a result of errors and/or fraud which may occur.

From time to time, answering a survey during a month may make you eligible to enter a monthly prize draw to win valuable items. The prize draws are governed by special terms and conditions. The results of the prize draws will be posted on our social media pages.

You will also earn Points for each friend or family member you successfully refer to the Platform or to the survey by sharing a unique link that we share with you for referral purposes. A referral is considered successful only if the referred person creates and validates an account on our Platform, complete the profiling survey and at least one active survey.

When doing referrals, you undertake:

• not to act as an Arab Views representative;
• not to act in a fraudulent or misleading manner;
• to act in a transparent and honest manner by disclosing to the referred person that you may be eligible to earn Points from such referral.

Friend referral terms:

• A successful referral will allow you to win a total of three (3) Points.
• A referral is considered successful if the referred person completes the full registration process by providing all information needed and answering the profiling survey.
• ArabViews may at its own discretion reject any referred upon reviewing it.
• ArabViews may at its own discretion disable the referral link if, for example, the link is used in an untoward or inconvenient manner or if we feel that we don't need more panelists.

Points Policy:

• Points are only earned upon satisfactory survey completion;
• Points are only earned on double opt-in referrer;
• Only one Points redemption is allowed per week; and
• Points cannot be transferred to any other panelist or account.

1. Accounts Closure or Termination

Your account will be permanently closed and you will be banned from the Platform should you breach any of the terms and conditions of these Terms, or be found to be providing untrue, inaccurate, or false or misleading information; or sharing misleading or inaccurate information about Arabviews.

Your account will be permanently closed and you will be banned from the Platform if we become aware of your acting as a representative of ArabViews in any such way.

The occurrence of the following events (“Event(s)”) can lead to a termination of your account with us:

• Your providing of untrue, inaccurate, false or misleading information;
• Your inactivity for more than 12 months on the Platform.
• Your breach of these Terms.
• Your request to close your account.

Any such Event can cause you to

• lose your unused Points and consider such Points forfeited;
• not be able to sign-in using your credentials unless you request to reactivate your account and we agree to such request.

1. Platform Content and Copyright

The Platform contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, photos, video, graphics, music, sound and software.

The entire content of the Platform is copyrighted under applicable copyright laws. You may not modify, publish, translate, transmit, participate in the transfer or sale, create derivative works from, or in any way exploit, any of this Platform’s content, in whole or in part.

Where made available for download by the Company, you may download copyrighted material for your personal use only. Except as otherwise expressly permitted under applicable laws, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without our express permission and/or the copyright owner. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made.

1. Disclaimers and Limitation of Liability

The Platform’s content, including the information, names, images, pictures, logos and icons regarding or relating to the Company, its products and services (or to third party products and services), is provided "as is" and on an "is available" basis without any representations or any kind of warranty made (whether express or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

We cannot ensure that you will be satisfied with any content on our Platform. We have not taken any steps to confirm the accuracy or reliability of any of the information contained in our Platform.

Under no circumstances, including, but not limited to, negligence, shall we be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of, or the inability to use, the Platform or materials or functions on our Platform, even if we have been advised of the possibility of such damages.

You might access third party links that are published on the Platform. You agree and acknowledge that we are not responsible for any linked sites and that your access to and use of any third-party sites will be governed by the terms and conditions of such third-party site as applicable.

You understand and agree that some surveys have been provided and fulfilled on behalf of ArabViews (our) suppliers. The content of these surveys has not been verified by (us) and (we) are not liable for the scripting of these surveys nor for their compliance with applicable laws and regulations.

1. General Provisions

These Terms shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the Federal Laws of the United Arab Emirates as applied in Dubai.

You acknowledge and agree that any dispute arising out of or in connection with these Terms or your use of or access to the Platform shall be resolved through arbitration in accordance with the rules of arbitration of the Dubai International Arbitration Centre (“DIAC")
